Anthology Statement of Agreement
This agreement is made between the publishing branch of Speak Through Me Communications, P.O. Box 382131, Germantown, TN 38183-2131, hereafter referred to as Speak Through Me Publishing and the participating co-author, herein referred to as Author.
By signing this agreement, the above Author warrants that he/she has legal authority to grant the following permissions and enter into these agreements. The above Author grants permission to include his/her chapter, hereafter referred to as Work in this collaborative work, hereafter referred to as Anthology, in the English language worldwide. The Author hereby represents and warrants the following to Speak Through Me Publishing The Work is free and clear of any counts of libel, plagiarism, breach of privacy, misrepresentation of facts, explicit sex, profanity, or inflammatory content. The Work does not infringe upon any copyright or proprietary right nor and does not contain material of libelous nature. The Work is not in the public domain and the Author is the representative of the Work as a whole with full power to enter into this agreement. If the Work has been previously published in the whole or in part, the Author currently holds authorization from the copyright holder to enter into this agreement. The Author acknowledges that the Work is not available as a free download anywhere on the Internet nor is it currently available in whole from the Author's website. The Author releases Speak Through Me Publishing, the Project Manager, Publisher/Organizer, and all related entities, from any obligations relating to any legal actions incurred by the contents of the Work or of the Author. Additionally, it will be the responsibility of the Author to pay all legal fees related to the Author's negligence or breach of this agreement. The Work has not been nor will be published by any other entity outside the realm of the Publisher/Organizer, the Author’s personal collection, or Speak Through Me Publishing. The Author grants Speak Through Me Publishing (and its related entities), the Project Manager, and the Publisher the right to edit/revise the Work as deemed necessary as directed by the Editors. The message will remain that of the Author; however, the final wording will be at the discretion of the Editor. Author’s Name Speak Through Me Publishing shall have the right to use the Author’s name, photo, and biographical material for the purpose of advertising, publishing, or promoting the Anthology. This includes use of excerpts from the individual Work for promotional purposes. Author’s Rights The Author retains full copyright ownership for his/her Work. The Author has the right to use excerpts of his/her Work for promotional purposes in any way deemed appropriate as agreed upon by both the Author and the Publisher/Organizer. The Author has the right to resell the anthology as a whole in the physical copy version only. The Author does not have the right to publish the anthology as a whole in any manner including physical copies and electronic copies. The Author agrees not to publish or permit others to publish the Work in any form prior to its publication in the anthology or afterward. However, the Author is free to publish his/her Work in his/her personal collection of works. The Author grants Speak Through Me Publishing the following continuing rights Speak Through Me Publishing is granted the right to publish the Work in the English language in both print and electronic editions of the Work worldwide within the Anthology, as an excerpt for promotional purposes, or within a “Best Of” series. The Publisher and Speak Through Me Publishing are granted the permission to contract with distributors to sell the Work in association with the Anthology under the Publisher's name. No right is given to Speak Through Me Publishing to publish the individual Work outside of the Anthology or in the name of Speak Through Me Publishing except for the permissions granted above. Copyrights The Publisher/Organizer holds the copyright for their contribution only. Each Author maintains the copyright and all other rights to his/her individual Work. Each Author shall grant permission to the Project Manager, Publisher/Organizer, Speak Through Me Publishing, and all participating authors to print and sell the Work in its entirety only. They are not granted the right to copy, sell, publish any sections outside of their own Work without written permission from the copyright holder. Financials The Author agrees to pay the assigned amount for inclusion in the Anthology according to the guidelines set forth by the Project Manager and/or the Publisher/Organizer. The Author is expected to submit all monies and materials on or before the prescribed due dates. Book Copies The Publisher/Organizer and Speak Through Me Publishing will have the ability to purchase additional copies through the main publishing account. Instructions will be given via video for the author to set up their individual book printing account. The Author has the full right to order and resell copies at will. The Author is not granted the right to publish the anthology. Cover Art All cover art produced or contracted by Speak Through Me Publishing shall be the property of the Publisher/Organizer excluding the Author's image. The Author has the right to use the cover art in promoting the Work and/or Anthology on their website, social media, flyers, bookmarks, etc. for as long as this agreement is in effect. The right is revoked if the Author or Publisher/Organizer cancels this agreement. The Publisher/Organizer, Speak Through Me Publishing, and the Project Manager have sole discretion and artistic license to design, layout, and/or contract with a third party to implement any and all cover art or artwork associated with the Anthology and are under no obligation to obtain permission from the Author before release. |
